In developing contract packages for the construction industry, I understand that contractors want to strike a balance between ensuring that they are legally protected and preserving valuable customer relationships.
In most New England states, the law provides contractors with special lien rights to provide them with security in the event of an up-chain payment default. The contractor’s lien (or “mechanic’s” lien) has priority over several other types of previously recorded liens, making it a powerful tool in any payment dispute.
When dealing with payment default, it is not uncommon for clients to learn that the project is in serious financial trouble or on the verge of bankruptcy. When it appears that there may be no financially stable source of payment, construction bonds can come to the rescue.
In a construction dispute, there are several alternatives to litigation. These litigation alternatives are collectively referred to as “alternative dispute resolution” or ADR.
